Americans with Disabilities Act (ADA)
Regulations and Eligibility Standards (revised effective March 15, 2010)
On September 15, 2010 the U.S. Department of Justice issued revised regulations for Titles II and Title III of the Americans with Disabilities Act (ADA).
The new regulations, including revised eligibility standards, became effective on March 15, 2011. The new regulations can be found at 28 C.F.R. Parts 35 and 36. The purpose of the revisions was to implement regulations that comport with the legal and practical experience of the Department in enforcing the ADA since 1991. It should be noted that these regulations have no effect on any State or local laws that provide protections greater than or equal to that provided by the ADA. Compliance with less stringent state or local laws will not constitute compliance with the ADA.
